Party A (Applicant):
Party B (Issuer):
Party A voluntarily applies for Peony Credit Card and Party A and Party B sign the contract through negotiation when party A knows and understands ICBC Peony Credit Card Procedures and the contract text.
I. Party A guarantees to provide true and liability application materials and is willing to cooperate with Party B to investigate and know the related credit standing, property and other information for related department, unit or individual.
II. Party B grants credit limit of RMB____________for the Peony Credit Card account of Party A according to Party A's credit standing and has right to raise or lower the credit limit of Party A's account. Overdrawing period of the credit limit is 60 days after bank accounting day.
III. Party A shall bear all the liabilities occurred under the Peony Credit Card (including principal and interest within or beyond the credit limit, penalty, limit-beyond fee, annual fee, service fee, etc.).
Party A should pay interested loan and then un-interested loan. The priority of repayment shall be interest, fees (limit-beyond fee and penalty, etc.), disbursement loan, transfer loan and consumption loan.
IV. Party A shall repay all the liabilities within the specified overdrawing period. Otherwise, Party B shall have right to dispose mortgage/pledge/pledge right as agreed according to law and claim from the guarantor.
V. Party A shall abide by ICBC Peony Credit Card Procedures, fulfill related terms of the contract and sign the same name as that on the valid ID certificate personally in the Signature Panel on the back side of the Peony Credit Card (the signature should be easily distinguished). Party A shall remember well and keep the password properly, otherwise, Party A shall take responsibility for the consequences arising from this.
VI. Except using password or Card with Color Photo, Party A shall present its valid ID certificate for consumption, transfer or disbursement with the Peony Credit card. All the transaction completed with password is deemed as done by Party A itself.
VII. Party A shall not refuse payment to Party B with excuse of disputes with special emporium.
IX. Party B shall undertake the following obligations:
(I) Provide Peony Quasi-Credit Card Procedures, operation instructions and Fee Schedule, etc.;
(II) Build complaint system, publicize the complaint procedures and complaint telephone number;
(III) Provide reconciliation service;
(IV) Provide written loss report and telephone loss report service. Written loss report is formal one. Issuer only assists to prevent loss for telephone loss report and takes no responsibility for it.
(V) The request for account enquiry and correction by the card holder shall be replied within 30 days.
(VI) Party B shall keep confidence for the credit standing of the Party A unless otherwise specified by the national laws and regulations.
IX. Party A shall have right to enjoy various services provided by Party B, have right to supervise and complaint against the service quality of Party B and have right to claim bank statements in the last three months from Party B.
X. The card holder shall make reconciliation in time and enquiry or issue correct requirement for the inconsistent account if any within 10 days after claiming the bank statements.
If Party A fails to receive the bank statement within 10 days after the issuance of them, it shall claim them in time, otherwise, they will be deemed as received by Party A.
XI. Party A shall give a notice to Party B in writing immediately when the contents filled in the application form are changed. Party A shall take responsibility for the economic losses arising from this if it fails to fulfill the obligation.
XII. Party A breaks the contract if it rents, or lends peony card or its account to others. Besides correction is required within time limit, Party A shall pay RMB1,000 as penalty and agree Party B to transfer the amount form its account.
XIII. If Party A loses the Peony Credit Card, it should handle loss report procedures in time in the nearby issuer. Party B takes no responsibility for any economic loss from the loss of the Peony Credit Card in any of the following cases.
(I) Economic losses occurred before loss report and during the period after the issuer accepts written loss report and within 24 hours (included) of the next day
(II) That caused by Party A's fraud with others or other dishonest behavior;
(III) Where Party B is refused by Party S when investigating situations.
XIV. Maximum effective period of the Peony Credit Card is 2 years. If the cardholder doesn't want to apply a new card upon expiry, the card holder shall give a notice in writing or otherwise agreed by both parties to the issuer one month before the expiry date. Otherwise, the issuer will deem the cardholder is willing to apply a new card upon expiry. Expired Peony Credit Card must not be used but the application contract continues survive. If a cardholder doesn't want to apply a new card or stop using the card midway, it should pay all the liabilities and turn over the Peony Quasi-Credit Card to the issuer and processes the cancellation procedures. The contract is terminated after the account is cancelled.
XV. The Peony Credit Card is the property of Party B. In any of the following cases, Party B shall stop using the card without notice to Party A and can on its own discretion, or authorize related units to recover the Peony Credit Card and recover the outstanding liabilities of Party A:
(I) Party A breaks the procedures, contract and related regulations;
(II) Party A's credit standing gets deteriorated;
(III) In any of the cases occurred to guarantee under the contract while Party A fails to provide guarantee accepted by Party B:
1. Midway termination of the guarantee contract;
2. The guarantor loses its guarantee capacity;
3. Mortgage/pledge/pledge right is destroyed, extinguished or devalued greatly or their property is under disputes.
XVI. Issuer will have the card account cancelled for the Party A 30 days after receiving cancellation application submitted by the Party A. Capital in the business card account shall be transferred into basic deposit account when canceling the account.
XVII. The contract shall not change due to amendment of laws, regulation and procedures attached by the Peony Credit Card Procedures or amendment of the procedures, change of charger items or standards, interest rate adjustment, midway card change by the warrantee, and increase or decrease of the card holder of Party A and adjustment of Party A's credit limit, etc.
XIIIV. Modification or adjustment of interest rate, charge items and Fee Schedule of the Peony Credit Card comes into effect upon being published, no matter whether Party A receives the notice or not.
XIX. Disputes in connection with the agreement shall be settled through negotiation between both parties. If no settlement is made, the disputes shall be submitted to the local Peoples' Court of Party B for lawsuit.
XX. The contract comes into effect upon approval by Party B and expires upon account cancellation by Party A.
